Welcome to Blue Kola.

These Terms of Use (“Terms”) govern your access to and use of the Blue Kola platform, a technology service that connects workers and employers across Kenya.

By accessing or using Blue Kola, you agree to be bound by these Terms.

If you do not agree, you must not use the platform.

2. Platform Role

Blue Kola is a labor matching engine, not a job board or employer.

We provide technology that enables:

• Workers to showcase skills and receive opportunities
• Employers to find and engage workers

Blue Kola:

• Does not employ workers
• Is not a party to any agreement between users
• Does not control or direct work performed
• Acts solely as an intermediary technology platform

All decisions and engagements are made directly between users.

3. Eligibility

To use Blue Kola, you must:

• Be at least 18 years old
• Provide accurate and complete information
• Have the legal capacity to enter into agreements

We reserve the right to suspend or terminate accounts that violate these conditions.

4. User Accounts

You are responsible for:

• Maintaining the confidentiality of your account
• All activity conducted under your account
• Providing accurate and up-to-date information

You agree not to:

• Impersonate another person
• Provide false or misleading information
• Use the platform for unlawful purposes

5. Verification

Blue Kola may offer identity or profile verification features.

You agree that:

• Verification reduces risk but does not guarantee identity, reliability, legitimacy, or conduct
• Blue Kola does not conduct criminal background checks unless explicitly stated

Users remain responsible for conducting their own due diligence before engaging with others.

6. Jobs, Matches, and Engagements

Blue Kola may:

• Recommend matches between workers and employers
• Allow direct hiring without applications
• Enable search and discovery

However:

• We do not guarantee job availability or hiring outcomes
• We do not guarantee worker availability or performance

All agreements are made directly between users.

7. Payments

Blue Kola may facilitate payments between users.

You acknowledge that:

• Blue Kola is not an escrow service
• We do not guarantee payment completion or delivery of work
• Payment disputes are the responsibility of the involved users

We may integrate third-party payment providers.

8. User Conduct

You agree not to:

• Engage in fraud, scams, or misrepresentation
• Harass, abuse, or harm other users
• Use the platform for illegal activities

We reserve the right to suspend or terminate accounts for violations.

9. Disclaimers

The platform is provided “as is” and “as available.”

We do not guarantee:

• Accuracy of user information
• Reliability of users
• Continuous or error-free operation

Blue Kola disclaims all warranties to the fullest extent permitted by law.

Use of the platform is at your own risk.

10. Limitation of Liability

To the maximum extent permitted by law:

Blue Kola shall not be liable for:

• Any indirect, incidental, or consequential damages
• Loss of income, business, or opportunities
• Disputes between users

Our total liability shall not exceed:

• The amount paid to Blue Kola (if any) in the past 3 months, or
• KES 10,000 (whichever is lower)

11. Termination

We may suspend or terminate your access at any time if you:

• Violate these Terms
• Engage in harmful or illegal behavior
• Misuse the platform

You may also stop using the platform at any time.

12. Governing Law

These Terms are governed by the laws of Kenya.

Any disputes shall be resolved in the courts of Kenya.

13. Changes to Terms

We may update these Terms from time to time.

Changes will be indicated by an updated “Last Updated” date.

Continued use of the platform constitutes acceptance of the revised Terms.
